Terms of Service

What Clipnest is

Clipnest lets you save videos from YouTube, Vimeo and other websites as Clips, organize them into Boards, add timestamped Notes, work on Boards with other people, and share Boards or Clips through public links. We may change, add or remove features over time.

Your account

• You can sign up with an email address and password, or continue with Google. You must be at least 13 years old to use Clipnest, or older if the law where you live sets a higher minimum age.
• Give accurate information, keep your password to yourself, and tell us if you think your account has been misused.
• You're responsible for what happens under your account.
• If you continue with Google, Google's own terms also apply to your Google account. A Google account and an email sign-up with the same verified email address lead to the same Clipnest account.

Your content

• You keep ownership of what you create in Clipnest: your Boards, Notes, replies and tags (“your content”).
• You give us permission to store, copy and display your content only as needed to run Clipnest for you: for example, to show it to you on your devices, to the collaborators on your Boards, and to anyone with a public link you've turned on.
• You're responsible for your content and for having the right to share it. Don't post anything unlawful, or anything that infringes other people's rights.

Collaboration and public links

• A Board's owner decides who is on it and their role. Editors can add Clips, Notes and replies; viewers can watch and read. Collaborators can see each other's names and email addresses. Owners can remove others' shared Notes and replies from their Boards.
• When you add something to someone else's Board, its owner and the other people on it can see it. If you leave or are removed, you lose access to that Board.
• A public link lets anyone who has it view the Board or Clip, without an account, until the owner turns it off. Only share links with people you're happy to show the content to. Notes marked private are never included.
• Only invite people who expect to hear from you, and don't use invitations or mentions to spam or harass anyone.

Videos and video links

• Clipnest doesn't host, download or copy videos. Clips are links to videos on YouTube or Vimeo, played in that platform's embedded player, and their titles and thumbnails come from the platform, or direct links to video files on other websites, played by your browser straight from those websites.
• Clipnest uses YouTube API Services to play YouTube videos. By using Clipnest, you also agree to be bound by the YouTube Terms of Service, and YouTube's use of information is covered by the Google Privacy Policy.
• Vimeo videos are subject to the Vimeo Terms of Service and the Vimeo Privacy Policy.
• Only add direct video links you have the right to share, especially on Boards with other people or on public links. Don't link to unlawful content. We may remove Clips that break these terms.
• Videos belong to their creators. A video can stop playing in Clipnest if it is removed, made private, has embedding turned off, or is limited to other websites, or if a video link stops working; your Notes on it stay in Clipnest.

Acceptable use

Please don't:

• break the law or help anyone else do so;
• harass, threaten or impersonate others, or share content that does;
• try to access Boards, accounts or data you haven't been given access to, or get around Clipnest's security;
• interfere with Clipnest, overload it, or use automated tools to scrape it or create accounts.

We may remove content or suspend or close accounts that break these terms, or to protect Clipnest, its users or others.

Ending your use

You can stop using Clipnest at any time, and ask us to delete your account by emailing digitalastronautstudios@gmail.com. Deleting your account deletes your own Boards, Clips, Notes and replies. Clips you added to other people's Boards stay there and pass to those Boards' owners, and Clips others added to your Boards go back to them. The Privacy Policy explains the details.

No guarantees

Clipnest is provided “as is” and “as available”. We work to keep it running and your content safe, but we don't promise that Clipnest will always be available or free of errors, that it will suit a particular purpose, or that content will never be lost. Keep your own copy of anything important. Videos come from YouTube, Vimeo and other websites, and we don't control whether they stay available.

Limitation of liability

To the extent the law allows, Digital Astronaut Studios is not liable for any indirect, incidental, special or consequential loss or damage, or for any loss of data, arising from your use of, or inability to use, Clipnest.

Nothing in these terms excludes or limits any liability, or any of your rights, that can't be excluded or limited by law, including under consumer protection laws that apply to you.

Changes to these terms

We may update these terms. We'll post the new version on this page and update the date at the top. Continuing to use Clipnest after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. This doesn't take away protections that the law where you live gives you and that can't be changed by agreement.
